What is gateway 3 of the Building Safety Act?

Gateway 3 acts as the final checkpoint at the completion stage of a building acting as the decisive stop/go point before asset owners can start moving residents into a higher-risk building.

When is Gateway 3 mandatory?

In-flight Higher Risk Residential Buidling (HRRB) of which plans have been deposited by 1 October 2023 with construction already started and the placement of permanent foundations starts by 6 April 2024, may remain under existing building control. New buildings completed after the transition period must be Gateway 3 compliant.

What are the Building Safety Act Gateway 3 requirements?

The Gateway 3 application should contain as-built drawings of the building, including records of on-site changes to engineer and architect drawings, what has been installed on site including locations of all the mechanical, electrical and public health systems and components installed, as well as ensuring potential risks have been identified and mitigated and detail on how they are being managed and controlled.

What are the gateways for the Building Safety Act?

In order to gain more oversight and regulatory control over higher-risk buildings (residential buildings, care homes and hospitals which are 18 metres or more in height, or at least seven storeys), the Building Safety Act introduces the implementation of three gateways strategically placed at crucial points of design and construction. Gateway 1, planning gateway, has two key elements that require the developer to submit a fire statement setting out fire safety considerations as well as establish the Health and Safety Executive as a statutory consultee for relevant planning applications. Crucially, Gateways 2 and 3 act as a stop/go decision point. All construction must be verified and demonstrate that it has been completed according to the as-built design, as well as required standards and regulations.

Why can’t I use my Common Data Environment (CDE)?

While many contractors may already have a CDE today to manage project data, they may not be well equipped to manage the Gateway 3 process or be able gather a consolidated data set for a comprehensive building safety case.
